The type of personal information we collect 

We currently collect and process the following information:

  • Personal identifiers, contacts (for example, name and contact details)

  • GP contact details, including at times medical notes. 

  • Summary notes of sessions, Reports and Assessments. 

  • Referral letters, initial client contact form.

  • Appointments attended

  • Invoicing and costs of sessions. 

 

How we get the personal information and why we have it

Most of the personal information we process is provided to us directly by you for one of the following reasons:

  • Therapy enquiry

  • Request to attend therapy

  • Attending therapy

 

We also receive personal information indirectly, from the following sources in the following scenarios:

  • Any information received from referring persons/ parents/ guardians. 

  • Any information provided by insurance companies or other relevant health/ care professionals. 

 

We use the information that you have given us in order to offer you an appointment, to see if therapy might be a good option for you and to provide therapy to you.

 

We may share this information with your GP, other health/ care providers, insurance companies, other persons involved in your care. Typically, this would be with your prior consent. The only time that we may need to share information without your consent, is if we were concerned about your own health and safety or the health and safety of anyone else and where informing you about the sharing of this information, would place yourself or others at increased risk. We are required to break confidentiality if we become aware of acts of terrorism, safeguarding issues, illegal activity, or misuse of vulnerable adults.

Under the UK General Data Protection Regulation (UK GDPR), the lawful basis we rely on for processing this information are:

(a) Your consent. By requesting that we provide you with therapy services, you are consenting for your data to be held and processed by us. You are able to remove your consent at any time. You can do this by contacting Sian Lamey, MindBody Therapy Service info@mindbodytherapyservice.com

(b) We have a contractual obligation. Where we have entered into a contractual agreement to provide you with therapy services as requested by you and where there is a payable fee, then you are agreeing for us to hold and process your data.

(c) We have a legal obligation. We will hold and process your data, where we need to comply with legal or regulatory  obligations, such as maintaining accurate and up to date records of your care. 

(f) We have a legitimate interest. We will only hold and process your information, where we have a legitimate interest in providing you with the services that you have requested. If you contact us to enquire about therapy services but do not take this forward, we will delete your data. If we work with you offering you therapy then we will usually keep your records for 7 years after discharge, in line with legal and regulatory guidelines. 

 

How we store your personal information 

Your information is securely stored. Some of this information is digitally stored on secure systems and some information will be stored in paper format. 

We keep your personal information, such as name, address, contact details, clinical records for 7 years after you end therapy. We keep records of invoices and payments for tax purposes for up to 5 years. We will then dispose of your information by deleting digital copies of your data and shredding any paper copies of your data. 

 

Your data protection rights

Under data protection law, you have rights including:

Your right of access - You have the right to ask us for copies of your personal information. 

Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. 

Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances. 

Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances. 

Your right to object to processing - You have the right to object to the processing of your personal information in certain circumstances.

Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
